• Price

All fees and prices in Saudi Riyals rates/charges may appear in local currency based on the currency exchange rate.

• Change in prices

Site prices are subject to modification at any time. Prices may also vary due to product launches, promotions or sales. Prices for items that are out of stock or that are available for pre-order are valid during the promotional period after the order has been placed. The price of items may change which may vary with the pre-order price, customers will be informed and you will have the possibility to cancel the order. We reserve the right to update the prices displayed on the site from time to time, and after updating, they cannot claim against an order that has already been confirmed or delivered.

• Typos

Naqaa Al Ain Company seeks to ensure its accuracy in all item specifications, images, compatible signals, detailed specifications, pricing, links and any information related to the products contained in our website. • Orders

Order Placement:

Eye purity company suggests to customers to read the data several times before confirming the order. Eye purity company is not responsible for sending emails to the incorrect email address nor for sending parcels to the wrong delivery address if the data is filled in incorrectly

• Order processing time

Expect your order to be processed within approximately 24-48 hours, provided these items are in stock and there are no problems with payment verification. We do not provide same-day shipping. Applications are not processed on weekends and holidays

• Order Acceptance Policy

Your e-receipt or any other form of order confirmation does not imply our acceptance of your order, nor does it constitute a confirmation of our offer for sale. Eye Purity reserves the right at any time after receiving your order to accept or reject your application for any reason. Naqaa Al Ain reserves the right at any time after receipt of your order, without prior notice to you, to provide you with a quantity less than you ordered of any item. We may require verification or additional information before accepting any order

• Acknowledgment of receipt

Eye purity company will inform you of the status of your order by e-mail. You will receive all the tracking information of your drum via your e-mail on the Naqaa Al Ain website after processing your request or changing its status. You can also get your order status and other live updates by logging into your account on our website

We currently offer the following payment methods
Payment at the time of receipt (in Saudi Arabia – Madinah only)

In order to protect visitors to the site to the best of our knowledge, we have implemented a number of security policies and certificates. Naqaa Al Ain Company reserves the right to refuse delivery or processing of an order from customers who have not paid part or total of the previous order or who have an ongoing legal dispute. Naqaa Al Ain also reserves the right to take any necessary steps, including legal action in case of non-payment of the order or non-payment of fees by users.

• Invoices

An order form filled out online by the customer cannot be considered an invoice. Regardless of the method of purchase or payment, the customer receives his/her invoice inside the parcel when the order is delivered. A digital/paper copy of each invoice is recorded in our secure and encrypted database.

• Security

Eye Purity Company will take all reasonable precautions to ensure the security of any payment details included in your order However, without direct negligence on our part, we cannot be liable for any losses incurred as a result of unauthorized access to the information you may have provided. • Disputes

If any dispute, claim, controversy or difference (including in relation to any tort or statutory claim) (“Disputes”) arises out of, in connection with or in connection with this User Agreement, including (without limitation) any question as to the wording, the existence , scope, performance, interpretation, validity or expiration of the User Agreement or Terms, or any question about the legal relationships defined by the User Agreement or the consequences of its invalidity, the parties shall attempt amicably to settle disputes through negotiations in good faith within a period of thirty (30) days. In the event that there are disputes that have not been settled amicably between the parties concerned before the end of the thirty (30) day period, and the parties have agreed that the dispute shall be referred for resolution by binding arbitration as set forth below, in accordance with the rules of arbitration in the Kingdom of Saudi Arabia – the executive court in the city shall be considered Munawwarah, which controls (“the Rules”) is hereby incorporated by reference into these Terms. The number of arbitrators must be one. The parties to the arbitration must seek to agree on a single arbitrator who will be nominated to the Executive Court in Medina for appointment. If the parties fail to name a single arbitrator within 30 days from the date of serving the request on the defendant (or a period greater or less than what the Executive Court in Medina has determined), the sole arbitrator shall be appointed by the Executive Court in Medina.
Arbitration procedures must be conducted in Arabic and the award must be in Arabic. The previous provisions in this paragraph do not prejudice the right of Naqa Al Ain Company to request temporary relief at any time from any competent court (whether or not an arbitrator has been appointed), and Naqa Al Ain Company is not considered to have violated this agreement or infringed on the arbitrator’s powers by doing so.

If it is determined that you retain moral rights (including rights of attribution or integrity) in Content provided by you, you declare that: (a) you do not require that any personally identifiable information be used in connection with the Content, or any derivative works or upgrades; or updates thereto; (b) you have no objection to the publication, use, modification, deletion or exploitation of the Content by us or our licensees, successors and assigns; (c) you forever waive and agree not to assert or assert any moral rights of any author or any moral rights in any of the Content; (d) forever release us, our licensees, successors and assigns, from any claims that may otherwise be asserted against us by virtue of any such moral rights. Naqa Al Ain Company will not be responsible for third party claims for damages against customers, malfunction, delay, interruption of service, loss of business, loss or damage, deterrent damages, with or without Naqa Al Ain Company’s knowledge of the possibility of such claims or damages occurring.
IF YOU ARE DISSATISFIED WITH THIS SITE OR ANY CONTENT OR MATERIALS ON THE SITE, YOUR SOLE EXCLUSIVE REMEDY IS TO DISCONTINUE YOUR USE OF THE SITE. Furthermore, you agree that any unauthorized use of this website and its services as a result of negligence or default would result in irreparable injury to Naqa Al Ain Company and Naqa Al Ain Company will deal with any unauthorized use that will be subject to the terms and conditions in the User Agreement.
Products that are considered among the super offers or on which there is a high discount from the company may be limited in quantity in each order, and the company has the right to change the required quantity for these products or cancel the order with or without the customer’s approval.
Naqa Al Ain Company has the right to cancel any unpaid order under any circumstances without any responsibility towards the customer or otherwise. In the event that the order is paid, Naqa Al Ain Company retains the right as long as the amount paid is returned in full.

• Intellectual Property

All content included on the Site, such as text, graphics, logos, images, audio, video, data, and music, is owned or licensed property of Naqaa Al Ain or its suppliers or licensors and is protected by copyright, trademarks, patents, and other proprietary rights. Content & Agreements

• Governing Law

The User Agreement shall be governed by and construed in accordance with the law of the Kingdom of Saudi Arabia. This is a condition for the expiration or cancellation of the User Agreement for any reason.

• Updates

We may update or change the Terms from time to time. The revised Terms will improve your future use of the Site, so we strongly suggest that you visit and review the Terms periodically. Each edition is dated. If you do not agree to the modified version, you must immediately stop using the Site.

The warranty is only on defects in workmanship and Eye Purity Company does not bear misuse and all warranty periods referred to are from Eye Purity Company, unless otherwise noted, and are limited to the manufacturer’s warranty policies. The actual manufacturer’s warranty periods may vary depending on the product and manufacturer, and contact with the eye purity company and the eye purity company will communicate with the manufacturer, some manufacturers provide direct exchange, shipping, or even a replacement the next day to your door. Please refer to the manufacturer’s website or product/packaging manuals for more information
In general, the manufacturer’s limited warranty will only guarantee the manufacturing defects of the product and will not cover any material damage to the product resulting from misuse, fall and other damage.
All communication for update/feedback on complaint tickets generated is done either by email or by call. In case the email or call is not answered for more than 3 days, the complaint card must be closed and a new complaint card will be required, provided that the item is still under warranty

• Claimable products

The warranty can be claimed on the basis of the following conditions:
Bring the original invoice
Products must not be used and do not show any signs of use.
Products in their original full packaging must be intact without any cutting or scratching.
Accessories and consumables included with products, components, tags, accompanying books, etc.
Shipping fees and processing fees are non-refundable
Material damage and/or missing products will not be considered unless reported at the time of delivery.
To ensure that complaints are successfully registered and addressed, all complaints must be submitted via our website, email or WhatsApp directly upon receipt of the product.

• Non-claimable products

The warranty cannot be claimed based on the following conditions:
Product accessories, only the basic product can claim warranty
Warranty cannot be claimed for free-fit or multi-colored products. Such as products listed on the site as multiple colors, free size, assorted colors, various designs, etc. They are products whose size/color cannot be guaranteed and are subject to their availability in stock.
If the products exceed the warranty period specified by the company

• Refund Policy

To claim a refund, please check whether the products purchased are within warranty as per the warranty policy. If the products are under warranty, you can claim a refund based on the following conditions
The customer can claim a refund for the purchased products within 3 days from the date of delivery of the products
After 3 days of delivery, the product(s) can only be repaired in accordance with the repair policy
Physical damage or missing products will not be considered unless they are reported at the time of delivery
The refund only covers the amount of the products purchased
Delivery and handling fees are non-refundable
If the coupon, discount, or special offer is part of the original order, the amount will also be deducted
The money will be refunded through the same payment method used at the time of placing the order

Collection process After the complaint is approved, the process of collecting the product from the customer will begin.
First within Medina in the Kingdom of Saudi Arabia
Within Medina in the Kingdom of Saudi Arabia: Products will be collected by the delivery team within Medina
There will be no pickup fee if the return request is raised within 3 days (72 hours) of delivery time.
A collection fee determined by the company applies if the return request is made after 3 days (72 hours) from the delivery time
A collection request can be rescheduled if canceled for any reason at no additional charge, however, if the second collection request is cancelled, the complaint ticket will be automatically closed.
Secondly, outside Medina
From outside Medina: The customer will have to return the product(s) at his own expense to the Naqa Al Ain Company headquarters service center or to the address specified by the company after communicating with it. Customer will have to pay shipping fees, customs and taxes (if any), and the tracking number must be updated on the complaint card within 3 days from the date the card was created. All shipments must be delivered to our warehouse within 15 days of ticket creation. If the item(s) are not received, the complaint ticket must be closed.
Inspection process: After receiving the product, it will be sent for inspection
Acceptable: If the products are found to be defective according to the policy, the refund process will be initiated
Not accepted: For products returned in damaged condition or without complete accessories or box – they will be returned to the customer.

• Return Policy

To claim a return of products, please check whether the purchased products fall under warranty in accordance with the warranty policy. If the products are under warranty, you can claim a return on the basis of the following conditions:
The customer can claim a return of the purchased products within .3 days from the date of delivery of the products
3 days after delivery, the Product(s) can only be returned in accordance with the return policy.
Physical damage or missing products will not be considered unless they have been reported at the time of delivery.
The refund only covers the amount of products purchased
Delivery and processing fees are non-refundable
If the coupon, discount or special offer is part of the original order, the amount will also be discounted
The products will be returned in the form of a coupon where it can be used to order the same products, similar products, or any other products of your choice. Please refer to the Coupon usage policy

• Reform policy

To claim repair of the products, please check whether the purchased products are within warranty according to the warranty policy. If the products are under warranty, you can request the return of the products based on the following conditions
Physical damage or missing products will not be considered unless they are reported at the time of delivery
Naqa Al Ain Company reserves the right to compensate the claim in the form of a coupon as and when it deems appropriate
Naqa Al Ain Company website can facilitate the process between you and the manufacturer of retail products, but will not cover any expenses incurred by the repair service.
Naqa Al Ain Company website service is limited to the level provided by the manufacturer or supplier. Please read the warranty information carefully before contacting us.

• Repair process

If the products are eligible for repair, please follow the process below to claim the products for repair

Pick-up fees determined by the company apply if the return request is submitted after 7 days (168 hours) from the delivery time.
A collection request can be rescheduled if canceled for any reason at no additional charge, however, if the second collection request is cancelled, the complaint ticket will be automatically closed.
Secondly, outside Medina
From outside Medina: The customer will have to return the product(s) at his own expense to the Naqa Al Ain Company headquarters service center or to the address specified by the company after communicating with it. Customer will have to pay shipping fees, customs and taxes (if any), and the tracking number must be updated on the complaint card within 3 days from the date the card was created. All shipments must be delivered to our warehouse within 15 days of ticket creation. If the item(s) are not received, the complaint ticket must be closed.

Claim your warranty is quick and easy
Products without a specified warranty period are considered unwarranted products and a complaint must be submitted within 72 hours from the time of delivery

Complaints will be accepted based on the following conditions
Products must be unused and show no signs of use
Sealed with manufacturer’s seal
Products must be in their complete original packaging – if the product is sold in the original packaging
Accessories, consumables included with the products, components, labels, literature, accompanying software, etc. must be provided
Physical damage and/or missing products will not be considered unless reported at the time of delivery
Naqa Al Ain Company reserves the right to compensate the claim in the form of a coupon as and when it deems appropriate
If the products are not defective and the order is made due to the products not meeting expectations, a collection fee determined by Naqa Al Ain Company and a restocking fee of 25% of the product value (for glasses only) will be applied, in addition to a discount on the value of prescription lenses.
Warranty cannot be claimed for free size or multi-coloured products. (Products listed on the site as multiple colors, free size, assorted colors, assorted designs, etc. are products whose size/color cannot be guaranteed and are subject to availability in stock.
